Workers are injured on the job every day in the U.S. According to a December 2014 report from the Bureau of Labor Statistics (BLS), more than three million non-fatal work-related illnesses and injuries were reported by private industry in 2013. During that same year, 4,585 workers were killed in on-the-job accidents, as reported by OSHA.

Although most workers are entitled to worker’s compensation benefits for a work-related injury or illness, full benefits may be difficult to obtain. If you have been injured on the job in Los Angeles, you can turn to The Los Angeles Auto Accident Attorneys for proven legal assistance with your workers’ compensation claim. We care about your physical and emotional recovery and we can help you pursue the resources you need for your medical treatment, your lost wages, and your future health.

The Importance of Workers’ Compensation

As reported by the Los Angeles Department of Labor and Employment (CDLE), workers’ compensation laws were first enacted in Los Angeles in 1915, during the Industrial Revolution, when work-related injuries became more frequent after the advent of mechanization. Workers’ compensation was introduced as no-fault insurance, designed to provide medical and wage replacement benefits for workers while limiting liability for employers.

Workers’ compensation has distinct advantages for employers as well as employees. In exchange for the benefits they are entitled to receive, workers’ are generally prohibited from filing civil lawsuits against their employers for on-the-job injuries or illnesses.

In the past 100 years, Los Angeles workers’ compensation law has been modified, according to CDLE, but the original intent of the Act remains intact: quick and efficient delivery of medical and disability benefits to injured workers at a reasonable cost for employers.

Injuries Covered By Workers’ Compensation

According to CDLE, Los Angeles employers must provide workers’ compensation coverage for their employees. This insurance provides benefits for workers who are injured in on-the-job accidents or who develop occupational illnesses. With very few exceptions, regardless of who caused the accident, any work-related injury is covered by workers’ comp. Examples of workers’ compensation-covered injuries include:

  • Overexertion injuries
  • Injuries from falling objects
  • Slip or trip and fall injuries

According to the Los Angeles Division of Workers’ Compensation, benefits may be reduced if a workplace injury occurred under certain circumstances, including:

  • Injury resulting from the worker’s use of drugs or alcohol.
  • Willful failure of the worker to use a safety device.
  • Willful failure of the worker to obey a reasonable, written and posted safety rule.

Important Steps to Take Following an Injury at Work

  • According to CDLE, an injured worker must report an injury to his or her employer immediately.
  • Injured employees should seek emergency medical treatment if needed.
  • As stated by CDLE, if the injury is not life-threatening or limb-threatening, the worker should select a medical provider specified by the employer.
  • If mentally and physically able, an injured worker should notify the employer in writing within 4 days of the injury.

Benefits Available to Los Angeles Workers’ Compensation Victims

In addition to covering your authorized medical expenses, workers’ compensation will provide partial reimbursement of wages lost because of the injury or illness. Benefits provided by Los Angeles workers’ compensation insurance include:

  • Temporary Total Disability (TTD): When a worker is temporarily but totally disabled and unable to work at all.
  • Temporary Partial Disability (TPD): When the injured worker returns to work with modified duties and reduced hours and wages.
  • Permanent Partial Disability (PPD): For permanent loss of function of a body part or system caused by the injury. The treating physician will award a percentage of permanent impairment on which benefit amounts will be based.
  • Permanent Total Disability (PTD): When the injured employee is permanently and totally disabled as a result of the workplace injury or occupational illness.
